1. SCOPE OF APPLICATION

These General Terms and Conditions of Sale (hereinafter the “T&Cs”) apply by operation of law to all commercial relations between PAYETO, owner of the “Maison Renée Paris” brand, whose registered office is located at 81 rue de Silly, 92100 Boulogne-Billancourt, registered with the Nanterre Trade and Companies Register under number 922 287 826 00015 (hereinafter “PAYETO”), and any consumer within the meaning of the introductory article of the French Consumer Code (hereinafter the “Client” and together the “Parties”), wishing to purchase “Maison Renée Paris” brand products marketed by PAYETO (hereinafter the “Products”) on the website www.maison-renee.com (hereinafter the “Site”).

The purpose of these T&Cs is to define the conditions under which PAYETO sells the Products to Clients and, as such, they set out in particular the conditions of ordering, payment, delivery and management of any returns of Products. In this respect, it is specified that the Products are offered for delivery to France and to countries that are part of the European Union.

The T&Cs apply to the exclusion of all other conditions, in particular those applicable to in-store sales or via other distribution or marketing channels. They prevail over any other document issued by PAYETO, which is for information purposes only, as well as over any other document whose provisions derogate from these T&Cs and which has not been expressly accepted by PAYETO.

The Client declares that they have taken note of the T&Cs prior to placing any order and that they have accepted them by ticking the box provided for this purpose before registering the order. The Client may consult the T&Cs at any time on the Site by clicking on the “General Terms and Conditions of Sale” link located at the bottom of the Site page.

PAYETO reserves the right to amend the T&Cs at any time. The version applicable to the Client’s purchase is the one in force on the Site on the date the order is placed.

2. PRODUCTS

The Products offered by PAYETO are those listed on the Site on the day of consultation by the Client.

Each Product offered for sale on the Site is the subject of a precise description of its essential characteristics, within the meaning of Article L.111-1 of the French Consumer Code, on the page of the Site dedicated to that Product.

The photographs relating to the Products are provided for information and illustration purposes only and have no contractual value. The Product delivered may differ from the representation on the Site; however, PAYETO guarantees that the essential characteristics of the Product will be identical.

PAYETO informs the Client if a Product is unavailable, in particular by indicating this on the Site, by any means whatsoever. Products added to the basket by the Client are not reserved. Consequently, a Product may become unavailable between the time it is added to the basket and the time the Client validates the basket.

3. PRICES

The prices of the Products are indicated on the Site in Euros, including all taxes (VAT included), excluding shipping, packaging, transport and delivery costs, which are invoiced in addition under the conditions set out in Article 6 “DELIVERY” of the T&Cs.

The sale price of the Products is the price in force on the day of the order. The prices displayed on the Site are set by PAYETO.

PAYETO is free to determine its own promotional policy. Thus, promotional offers are specific to the Site and may differ from those offered by other distributors or resellers. Promotional offers apply to any order placed during the period of the promotion indicated on the Site, within the limit of available stocks.

4. ORDER

4.1 Basket

The Client composes their basket as follows:

The Client browses the Site and goes through the list of Products, selects the Product(s) of their choice, enters the desired quantity and clicks on the icon symbolising the addition of the Product(s) to the basket.

4.2 Contact details and delivery method

To finalise the order, the Client is invited to create or log in to their client account. The creation and use of the client account are governed by the provisions of Article 5 “CLIENT ACCOUNT” of the T&Cs.

Once logged in, the Client confirms, modifies or completes their delivery and billing details (surname, first name, address, city, postal code, country, email address and landline or mobile phone number).

The Products are delivered to the address provided by the Client. In this respect, it is recalled that the Products sold on the Site can only be shipped to France and the European Union. If the Client’s order is greater than €300, the Client may opt, at no additional cost, for standard delivery.

The delivery price is the one indicated on the Site before the order is validated.

4.3 Order summary and validation

The Client checks the content of their order and takes note of the T&Cs. They then declare that the T&Cs have been made available to them and that they fully and unreservedly accept them by ticking the acceptance box provided for this purpose before clicking on the “Order” button.

Once the order has been validated, it can no longer be modified.

4.4 Payment

Payment for the Products is made by bank payment card (Carte Bleue, Visa, Mastercard or American Express) or via PayPal or Apple Pay / Shop Pay. The Client guarantees PAYETO that they are fully authorised to use the payment card to pay for their order.

All payments are subject to a secure data encryption procedure so that no information transmitted by the Client can be intercepted by third parties. PAYETO cannot be held liable in the event of fraudulent use of the payment method used by the Client, except in the event of negligence or gross fault attributable to PAYETO having led to the fraud.

4.5 Order confirmation

The Client receives a confirmation email recalling their details, the details of the order, its price and the delivery address.

Irrespective of the sending of the order confirmation, the order will only be processed and dispatched by PAYETO once the banking transaction has been validated and full payment has been received.

The purchase invoice for the Products is sent to the Client electronically together with the order confirmation. The Client may also consult, download or print their invoice directly from their client account under the “My orders” tab.

5. CLIENT ACCOUNT

5.1 Creation and use of the client account

The client account allows the Client to manage their orders. The Client undertakes to make reasonable use of their client account, in compliance with the Site’s T&Cs and in a manner that is not contrary to PAYETO’s interests nor likely to harm its image.

5.2 Deletion of the client account

In the event of non-compliance with these obligations and also, without limitation, in the event of payment incidents, provision of incorrect information when creating the account or placing an order, or acts that may harm its interests, PAYETO reserves the right to suspend, temporarily and at any time, the Client’s access to their client account. PAYETO will inform the Client of the suspension of their account and of the reason for this action.

In the event of serious or repeated breaches, PAYETO may, where appropriate, delete the Client’s account without the Client being entitled to claim any compensation. In this case, PAYETO will inform the Client of the deletion of their account and of the reason for this action.

If the Client wishes to delete their client account on their own initiative, they shall send their request to Customer Service at the email address contact@maison-renee.com or follow the deletion procedure available from their client account.

Deletion of the client account will have no impact on orders in progress.

6. DELIVERY

For one-off Product orders, delivery costs are calculated according to the delivery method chosen by the Client (home delivery or collection point).

The Products are delivered to the delivery address indicated by the Client when placing the order. The transfer of risk to the Client takes place when the Client physically takes possession of the Products.

The Products are delivered within four (4) to five (5) working days in mainland France from the order confirmation, to the address indicated by the Client. PAYETO undertakes to make its best efforts to deliver the Products ordered by the Client within this time frame. However, the delivery time is indicative, and any overrun of this time frame shall not give rise to any payment of damages by PAYETO nor justify refusal of the Products by the Client.

If the Products ordered have not been delivered within fifteen (15) days after the indicative delivery date, for any reason other than force majeure, the order may be cancelled at the written request of the Client under the conditions provided for in Articles L.216-6 and L.216-7 of the French Consumer Code.

In this case, the Client must contact Customer Service at the following email address: contact@maison-renee.com. The sums paid by the Client will then be refunded at the latest within fourteen (14) days following the date of cancellation of the order, excluding any compensation or retention.

In any event, PAYETO cannot be held liable in the event of non-delivery of Products due to an error by the Client in entering their contact details. In such a case, no refund or reshipment of Products can be made.

7. RIGHT OF WITHDRAWAL – NON-CONFORMING PRODUCT – HIDDEN DEFECT

7.1 Right of withdrawal

In accordance with the regulations, the Client has a period of fourteen (14) clear days from receipt of their entire order to exercise their right of withdrawal without having to give any reason or pay any penalties, with the exception, where applicable, of the return costs.

Where the fourteen (14) day period expires on a Saturday, Sunday or public holiday, it shall be extended until the next working day.

To exercise this right, the Client must, within this period, inform PAYETO Customer Service of their intention to withdraw, by email to contact@maison-renee.com by  means of an unambiguous statement or by following the withdrawal procedure accessible from their client account.

PAYETO will send the Client a return label by email or make the return label available in their client account. PAYETO will then inform the Client of the procedure to follow to return the Product(s).

The maximum period for returning the Product(s) to PAYETO is fourteen (14) days from notification to PAYETO of the decision to withdraw. The Product(s) must be returned in their original packaging or in any packaging suitable for the Product(s) concerned, still sealed and in perfect condition. Otherwise, the Products will not be taken back.

The Client bears the cost of returning the Products.

In the event of the right of withdrawal being exercised, only the price of the Product(s) concerned by the withdrawal and the delivery costs will be refunded. If the Client has chosen a more expensive delivery method than the standard delivery method offered by PAYETO, the refund of the delivery costs will be limited to the cost of standard delivery.

The refund will be made no later than fourteen (14) days from the date of receipt of the returned Product(s). The refund will be made using the same means of payment as that used by the Client for the purchase of the Products.

7.2 Lack of conformity or hidden defect of the product

Independently of the right of withdrawal, in the event of delivery of a Product that does not conform within the meaning of Articles L.217-3 to L.217-7 of the French Consumer Code, or that presents a hidden defect within the meaning of Articles 1641 to 1649 of the French Civil Code, the Client may request the exchange or refund of the Product. Beyond the legal guarantee periods provided for by the French Consumer Code and the French Civil Code, no exchange or refund will be made.

To do this, the Client must contact PAYETO Customer Service by email at: contact@maison-renee.com.

Any request must be accompanied by photographs of the Product enabling Customer Service to verify the reality of the non-conformity or hidden defect alleged by the Client.

In the event of a proven non-conformity or hidden defect, PAYETO Customer Service will inform the Client of the procedures for returning the Product and PAYETO will, at its sole expense and in accordance with the arrangements agreed with the Client, replace or refund the non-conforming or defective Products. In the event of a refund, this will be made as soon as possible and at the latest within fourteen (14) days following receipt by PAYETO of the non-conforming or defective Product. The refund will be made using the same means of payment as that used by the Client for the purchase of the Products.

PAYETO’s guarantee is, in any event, limited to the replacement or refund of Products that are non-conforming or affected by a defect. PAYETO’s liability cannot be incurred in the event of misuse of the Product(s), use for professional purposes or negligence on the part of the Client, nor in the event of an accident or force majeure.

8. WARRANTY – LIABILITY

The Products delivered by PAYETO are deemed to conform in quality and quantity to the order. Where applicable, it is the Client’s responsibility to make any reservations, in accordance with Article 7 “RIGHT OF WITHDRAWAL – NON-CONFORMING PRODUCT” of the T&Cs.

In accordance with the legal provisions, PAYETO warrants the Client against all lack of conformity of the Products and all hidden defects resulting from a defect in design or manufacture of the said Products, excluding any negligence or fault on the part of the Client.

PAYETO’s liability can only be sought in the event of damage caused directly by the Product(s) under the normal conditions of use recommended by PAYETO in each Product sheet, and without alteration, modification or transformation by the Client.

In such a case, PAYETO will replace the Product(s) or refund the Client, under the conditions referred to in Article 7 “RIGHT OF WITHDRAWAL – NON-CONFORMING PRODUCT” of the T&Cs.

In any event, PAYETO’s liability is limited to direct losses only, to the exclusion of any indirect loss of any kind whatsoever, and to the tax-exclusive amount paid by the Client for the purchase of the Products, except in the event of personal injury, fraudulent misrepresentation or gross or intentional fault attributable to PAYETO.

9. PRE-CONTRACTUAL INFORMATION – CLIENT’S ACCEPTANCE

The Client acknowledges that, prior to validating their order, they received, in a readable and comprehensible manner, these T&Cs and all the information and details referred to in Articles L.111-1 to L.111-7 of the French Consumer Code, in particular: the essential characteristics of the Products, the price of the Products and ancillary costs (delivery, etc.), the delivery date or time frame, the identity of the seller (PAYETO) under the name "Maison Renée Paris", the methods of payment and delivery, the legal and contractual guarantees and how to exercise them, and the right of withdrawal.

10. INTELLECTUAL PROPERTY

The trademarks, including those relating to the Products, all distinguishing signs such as logos and the associated graphic charter, the texts and graphic elements, as well as their arrangement on the Site and the Site itself are and remain the exclusive property of PAYETO. They are protected by intellectual property rights, in particular copyright and trademark law.

The purchase of the Products does not confer any rights whatsoever on the Client over the trademarks and distinguishing signs of the Products.

11. FORCE MAJEURE

PAYETO’s liability cannot be incurred where the non-performance or delay in the performance of any of its obligations is due to an event of force majeure within the meaning of Article 1218 of the French Civil Code, including but not limited to acts of terrorism, armed conflicts and riots, industrial disputes internal or external to PAYETO, government intervention affecting the production or storage of goods, any total or partial interruption in the supply of raw materials, any accident affecting the production or storage of Products, acts of a client, supplier or third party, or any type of epidemic, pandemic, illness or health risk affecting the global or local population, which prevents or disrupts the performance of the order.

In the event of force majeure, performance of the order will be suspended for the duration of the force majeure where it is temporary. If the suspension due to the force majeure event lasts for more than thirty (30) days, performance of the order will be automatically terminated and neither Party may claim damages in this case. The sums paid by the Client will then be refunded at the latest within fourteen (14) days following the date of termination of the order.

12. PERSONAL DATA

The Client may be required to provide PAYETO with documents or information containing personal data concerning them, in particular when creating and using the client account, when placing and/or performing the order, during any exchanges with Customer Service or otherwise.

The collection, processing, storage and/or use of the Client’s personal data are governed by the Personal Data Protection Policy implemented by PAYETO and accessible on the Site or by clicking on this link.

In any event, any Client who has provided personal data has the right to access, rectify and delete the data concerning them.

14. APPLICABLE LAW – DISPUTES

The T&Cs are governed by French law.

In the event of any disputes relating to the validity, interpretation and performance of the T&Cs, the order or any agreement entered into pursuant hereto, the Parties undertake to seek an amicable solution before referring the matter to the courts.

The Client is informed that they may in any event resort to mediation with a body of their choice:

  • Centre de Médiation et d'Arbitrage de Paris (CMAP), by post sent to 39 avenue Franklin D. Roosevelt, 75008 Paris, or by email at: cmap@cmap.fr

  • Online dispute resolution platform (ODR), accessible via their website.

The Client is informed that their request cannot be examined by the consumer mediator where:

  • The Client cannot demonstrate that they have first attempted to resolve their dispute directly with PAYETO by means of a written complaint, in accordance with the procedures set out in these T&Cs;

  • Their request is manifestly unfounded or abusive;

  • The dispute has already been examined or is currently being examined by another mediator or by a court;

  • The Client has submitted their request to the mediator more than one (1) year after their written complaint to PAYETO;

  • The dispute does not fall within the mediator’s remit.

All disputes relating to these T&Cs or to sales transactions concluded pursuant hereto shall be submitted to the jurisdiction of the competent court in the defendant’s place of domicile or, at the claimant’s choice, in the place of effective delivery of the Product.
